As you may be aware, I am no longer employed by AirNet. (Or, perhaps you aren't! I still get calls to my mobile phone that I have to politely re-direct to AirNet's main number...)
Many people have been asking me for the details of exactly what happened. For various reasons, I've been somewhat less that forthcoming. However, I hope that the saga is now over! So, to save myself from explaining it over and over again, here is a time line of events. This is all the information that I'm going to give out, so
please don't ask me for more details.
| 17 January 2002 |
My employment with AirNet was terminated. Under the terms of a settlement reached with AirNet (see later), this termination is a bona fide redundancy, and is completely fair. |
| 06 February 2002 |
I lodged a claim of Unfair Dismissal against AirNet in the SA Industrial Relations Commission. I also lodged a claim of Underpayment of Wages in the SA Industrial Relations Court. |
| 27 February 2002 |
A hearing in the Industrial Relations Court for the Underpayment of Wages claim was scheduled for the morning and a concilliation conference in the Industrial Relations Commission for the claim of Unfair Dismissal was scheduled for the afternoon. However, no representative from AirNet attended either the court hearing or the concilliation conference. Both were re-scheduled. |
| 04 March 2002 |
At the re-scheduled Industrial Relations Commission concilliation conference before Commissioner Lesses, an agreement was reached to settle my claim of Unfair Dismissal out of court. |
| 08 April 2002 |
At the re-scheduled hearing in the Industrial Relations Court before Industrial Magistrate Hardy, an ex-parte application was heard (i.e. AirNet did not have a representative present) at which AirNet was ordered to pay me $11,000.00. |
| 03 June 2002 |
I met with representatives of AirNet to sign a Deed of Release with regards to the prior claim of Unfair Dismissal. A notice of discontinuance for the claim of Unfair Dismissal was filed shortly after with the Industrial Relations Commission. This was in accordance with the out of court settlement that was reached with regards to the matter. |
| 06 June 2002 |
Mr. Colvin Burgess (one of the directors of AirNet) sent me what I believe is the funniest email I have ever read. I wish that I could publish it here. |
| 14 June 2002 |
After attempts to negotiate an alternative means of reaching a settlement of the $11,000.00 Underpayment of Wages debt failed, I faxed AirNet asking for the payment to be made in full. |
| 02 October 2002 |
After receiving no response to my fax of June 14 from AirNet, I applied to have a summons to witness served by a Sheriff's Officer of the Magistrates Court on Mr. Peter Karidis, one of the directors of AirNet. |
| 26 November 2002 |
AirNet's lawyer called and asked me to attend a meeting on November 27 (the next day) to talk about the Underpayment of Wages debt. |
| 27 November 2002 |
At a meeting with representatives of AirNet no agreement regarding an out of court settlement of the $11,000.00 Underpayment of Wages debt was reached. |
| 28 November 2002 |
In the Magistrates Court, Deputy Registrar Huie ordered AirNet to pay the off the debt to me ($11,079.80 including court costs) at $250.00/month with the first payment on or before 31 December 2002. |
|
23 December 2002 |
I received my first payment of $250.00 from AirNet. |
So, now you know!
